The U.S. Department of Education's Office for Civil Rights has determined that students with certain health conditions who have Individual Health Care Plans in Memphis, TN, district schools were not being properly evaluated and given the required disability-related services. The department also found that students were given different services based on race. These students qualify for services under [Section 504 of the Rehabilitation Act of 1973][1] (Section 504) and [Title II of the Americans with Disabilities Act of 1990][2]. Section 504 requires recipients of federal funding to provide services to students who are eligible for disability services.
