Garney Construction & Georgia Power to Pay $49, 500 to Settle EEOC Disability Lawsuit

The U.S. Equal Employment Opportunity Commission (EEOC) charged Garney Construction Co. and Georgia Power Company with violating the Americans with Disabilities Act because it denied employment to a job applicant with a disability. The applicant had previously worked for Garney, but when the individual applied this time for a job with Garney, the constuction company had a contract with Georgia Power, which required applicants to pass a physical examination. The applicant failed the physical exam because he was on medication for epilepsy. It is against the [Americans with Disabilities Act][1] to deny a job to an applicant because of a disability.
