Verdict Upheld for EEOC against Service Temps/Smith Personnel Solutions on Disability Discrimination

The U.S. Court of Appeals for the Fifth Circuit ruled in favor of the U.S. Equal Employment Opportunity Commission's (EEOC) disability discrimination lawsuit against Service Temps, Inc. The EEOC had charged that Service Temps, doing business as Smith Personnel Solutions, refused to hire a job applicant after learning that she is deaf. Under the [Americans with Disabilities Act][1] (ADA), employers must provide reasonable accommodations to an employee with a disability, unless it causes significant difficulty or expense for the employer.
